1. Acceptance of Terms

By downloading, installing, or using the Mapcut mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

Mapcut is a mobile application that provides real-time estimated time of arrival (ETA) calculations to your saved favorite locations. The App includes:

  • Real-time ETA calculations for driving, walking, biking, and public transit
  • Ability to save favorite locations
  • Home screen widget for quick access to ETAs
  • Featured business listings in the widget
  • Location-based business discovery

3. User Account and Registration

Currently, Mapcut does not require user account creation. The App functions without registration, though some features may require location permissions.

4. User Responsibilities

You agree to:

  • Use the App only for lawful purposes
  • Not interfere with or disrupt the App's functionality
  • Not attempt to gain unauthorized access to our systems
  • Not use the App while driving or when it would be unsafe to do so
  • Comply with all applicable traffic laws and regulations

5. Location Services and Privacy

The App requires location permissions to function properly. By using the App, you consent to the collection and use of location data as described in our Privacy Policy. You may disable location services at any time through your device settings, though this will limit App functionality.

6. Subscription Services

6.1 Free Tier

The free version of Mapcut includes:

  • Up to 4 favorite places
  • Basic ETA calculations
  • Small widget with ads

6.2 Plus Subscription

The Plus subscription includes:

  • Up to 10 favorite places
  • Ad-free experience
  • Large widget without ads
  • Calculate ETAs from any location

6.3 Billing and Cancellation

Subscriptions are billed through our website using Stripe payment processing. You may cancel your subscription at any time through your account dashboard or by accessing the Stripe customer portal. Cancellations take effect at the end of the current billing period.

7. Intellectual Property

The App and its content, features, and functionality are owned by Mapcut and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services.

8. Third-Party Services

The App may integrate with third-party services for map data, routing information, and other features. Your use of these services is subject to their respective terms and privacy policies.

9. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

ETA calculations are estimates only and may not reflect actual travel times due to traffic, weather, construction, or other factors. Always use your judgment when planning travel.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAPCUT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES.

11. Indemnification

You agree to indemnify and hold harmless Mapcut from any claims, damages, losses, costs, and expenses arising from your use of the App or violation of these Terms.

12. Termination

We may terminate or suspend your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will cease immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or other reasonable means. Continued use of the App after such changes constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
